Don’t ask justice; don’t ask fair investigation because India is moving on

By

Abdul Hannan Siwani Nadvi

As soon as Allahabad High Court Lucknow Branch pronounced its verdict on Babri Masjid title suite case on 30 September 2010 and when Muslim's defeat had been confirmed in this legal fight, some Media personals were on the way to hunt appropriate persons from Muslim community to know their opinions and ideas.

Meanwhile, some Muslim leaders and so-called liberal leaders from other communities have been seen advising Muslim community to forget this issue, close this chapter here and not to approach Supreme Court, even if they surrender 1/3 of land which is given to them by the court, it will set a great example of communal harmony because, according to them, India is moving on.

They were saying that Muslims and others have no interest to see the incident of 1992 again, because this is the year of 2010

As the news of legal defeat of Muslims escalated, the voices increased from every corner of the society that India is moving on, common man has forgotten that what had happened in the past. Muslims must forget it, leave this issue and surrender this land to Hindutva organizations because India is moving on.

It is said that people of India have become mature, they have left their past. They have forgotten what had happened in 1949.

There is a question, Is India moving on only for Muslims? Is India moving on only when the matter of Muslims comes to light? Is India moving on only when Muslims demand fair and correct justice?

Hundreds and thousands year old case is being discussed in 2010 only because India is moving on

If Hindutva organizations are not ready to surrender the land of Babri Masjid to its real owner, it is not matter, but Muslims must surrender their land and others too, to them because it will decide their patriotism and because India is moving on.

If it is being understand that the idols which were kept in the night of 22-23 December of 1949 inside Babri Masjid is indeed the birthplace of Ram, though, great and big Hindu pundits and Hindu scholars still are not in condition to say firmly that which place is exact birthplace of Ram, but we have to accept that the place of Babri Masjid is the birthplace of Ram, because India is moving on.

All innocent Muslim youths still are languishing in different Indian jails in fabricated terrorism charges, because India is moving on

State and Central government is not ready to clear the air surrounded on Batla House encounter, because India is moving on.

Muslim religious personalities are being subjected of discrimination and harassment in broad daylight only because this is 2010.

Yeddyurappa government passed a bill to ban on Cow slaughter in Karnataka because India is moving on.

A particular community in India feels itself a second class citizen because India is moving on.

Court's verdicts, government systems, mode of political parties and the way of nature of fundamentalist organizations always disclose to Muslims that they are second class citizens or their position is as there is nothing to be given to them because India is moving on.

RSS is similar as SIMI, as Mr. Rahul Gandhi said, but one is free and second one has been banned because India is moving on.

When Muslims demanded from concerned class of the country to debate on Gujarat pogrom and its consequences, and when it was demanded from the government to take stern action against the perpetrators, then this demand had been ignored and avoided saying that action against the perpetrators and debate on that pogrom could trigger more violence and hatred between two communities, but the perpetrators, conspirators and rapists of Indian constitutions had been given green signal to move freely in every part of India and take part in election, because India is moving on.

The same format repeated in current Babri Masjid case and said that this is 2010 and Indian citizen is not in condition to bear a chain of violence once again, but the country can bear injustice and atrocities because India is moving on.

Indian generation has much matured, despite of it, if it is silent on this big injustice its mean only that this is 2010.

Others are allowed to make bombs, to say and write what they want, ASI is allowed to confirm that an ancient, old and grand temple was inside central tomb of Babri Masjid after hundreds and thousands years, because India is moving on.

What happened if Muslims beheaded in Gujarat in 2002 but Muslim community must not demand justice in 2010 because India is moving on

Muslims must forget that what had happened on 6th December 1992 in Ayodhya, because India is moving on.

Most of the part of India shuts its doors when Maoists call one day or two day strike, but when Muslims ask justice, fair investigations, then said that India is moving on and people of India is not in favour to open old wounds.

Their terrorism is avoidable and much unimportant for most, but our talking on mobile can be considered as part of terrorism because India is moving on and this is 2010.

Court, Babri Masjid and Faith

By

Abdul Hannan Siwani Nadvi

Finally, Allahabad High Court has pronounced the verdict in long awaited Babri Masjid title suite case.

Instead to resolve the conflict and gives the justice to the victims, this verdict complicated the case more and raised other questions rather paves a way for true justice.

It would be a true justice, if the land of Masjid to be returned to Muslims who are the real owner of this land and the punishment to be pronounced for those who acted this criminal act, but it didn't happen so.

It was not asked the Court to divide the land, but was asked to clarify the ownership of the land. Instead to be clarified and ending the case in favour of its real owner, the Court divided the land into three parts.

The main question raised by various scholars is that how the court reached to the point which confirms the birthplace of Ram while there are other groups of Hindus who claim that it is not a specific birthplace of Ram.

This verdict which is based on faith and beliefs, I think, it will create big problems in the future for Muslims and others also.

Interestingly, that someone place idols inside the Masjid overnight, then their leaders start a movement in the name of religion to build a temple there claiming that Ram Lalla has appeared there, supported by administration and court on every step, one day Court gives its verdict in their favour because Hindus believe it, so what would be happened if Hindtuva leaders claim about every Masjid and about every institution in future and use same model played by them in Babri Masjid case.

If any court begins to pronounce verdicts according to faith, all Masjids, religious places and all institutions of Muslims will turn into temple and their captivity will be prevailed because court can confirm it on the base of faith, as we have seen in this case.

Then such cases will become an easy weapon for Hindutva organizations to take over of very Masjid and of every historical place of Muslims.

This kind of verdict can become a cancer for Muslim community in future.

Current Court’s verdict forced us to explore our minds to think of all the positive aspects for a better future.

This verdict may accepted by Muslims as a whole and they never think to approach Supreme Court, if it was given on the base of the evidences presented before the Court. But the judgment has been made in the sense in which it is not easy to say that such kind of verdict will not take place in the future if same incident is being framed about other Masjids.

In all situations, approaching Supreme Court is very necessary in order to be clear the real issue, though there is too little hope that Muslims will get the justice from Supreme Court too, if Supreme Court rejects the verdict taken on the base of faith, so I think that it will be a great victory for Muslims.

Looking towards the past, there is too little hope of success for Muslims in this case. But this issue or any other issue should not be leaved very easily, as some Muslim scholars are advising Muslims to surrender this land to those Hindutva organizations which are a threat for integration and unification of the country.

This Court’s verdict is a wake up call for Muslims that fight to get justice is not an easy step in current India.

In the light of this Court’s judgment, it is a clear indication for Muslims that only relying on Court cannot bring any ray of hope for them.

It is the need of the hour that Muslim leadership and Muslim political parties concentrate on all aspects and on those political ways can help them in getting a better place in the society where they do not feel that they have betrayed or they cannot get justice.
